IP Disputes

and avoiding them

We can help you avoid intellectual property (IP) disputes, as well as help you defend and enforce your IP rights.

You can reduce the risk of infringing someone else's IP rights by searching for IP which could potentially be infringed by your business, assessing the validity of third party IP, taking advice regarding your freedom-to-operate and, if appropriate, by helping set up a licensing arrangement with the IP owner.  Our attorneys are all very experienced in providing this type of analysis and advice and would be happy to assist you.

We regularly represent clients in Opposition and Opposition Appeal Proceedings at the European Patent Office, both to defend our clients’ patents when they are opposed and to oppose patents belonging to their competitors. Our trade mark attorneys also regularly advise clients on potential conflicts between mark holders and undertake negotiations to settle potential issues with co-existence agreements, as well as handling oppositions in the UKIPO and managing oppositions in other jurisdictions.

We can also represent clients in proceedings before the UK Intellectual Property Office, the European Patent Office and at the Unitary Patents Court.

When it comes to enforcing IP, and/or defending or attacking IP in court proceedings, we can assist clients, their solicitors and foreign attorneys in court proceedings.
